Council tax arrears

If you are paying by instalments and miss a payment we will issue a reminder. If you do not pay after this reminder has been sent you will lose your right to pay by instalments. This means that you will have to pay the remainder of your bill.

An application for benefit, discount, exemption or submission of an appeal will not stop proceedings.

If you still do not pay, we can issue a court summons. You will be charged £55.00 in costs.

What happens after a summons is issued

If you receive a summons for non-payment of council tax and have a query regarding your bill or the summons please telephone 01454 86 8003 BEFORE the date of the hearing so we can advise you further.

The court cannot accept payment or make any arrangements but if you contact us, we still may be able to make an arrangement with you to pay the debt.

Proceedings can only be stopped in some circumstances, for example;

  • you pay in full, including the costs, before the hearing date
  • you provide sufficient evidence to the council that you are not liable for the charge
  • bankruptcy or winding up proceedings have started against you
  • an Administration Order which includes this charge has been made by the County Court
  • it is more than six years since you have had a bill for this charge

If you do not pay the full balance including costs before the hearing then we will apply to the Magistrates’ Court for a liability order. This gives the council the power to start proceedings to recover the debt, however, we will give you the opportunity to make an arrangement first. Once the liability order is granted a further £27.50 costs are payable by you.

After the hearing you will receive a letter with a financial information form enclosed. You must complete and return this form within 14 days with your proposal to pay.  When we receive your form we will assess the proposal to pay and respond to you.
