This page provides information on the Public Examination of the South Gloucestershire Core Strategy.

Following submission to the Secretary of State on the 31 March 2011, the South Gloucestershire Core Strategy was subject to independent scrutiny during hearing sessions in June and July 2012 and an additional hearing session in March 2013.

The purpose of the Examination was to consider if the Core Strategy Development Plan Document (DPD) complies with the legal requirements and is 'sound'.  The Secretary of State appointed Mr Paul Crysell BSc MSc MRTPI as the Independent Inspector to conduct the examination.

Final Update

The South GloucestershireLocal Plan: Core Strategy (and accompanying Policies Map Changes) was adopted by South Gloucestershire Council at its meeting of 11th December 2013. Under Regulation 6 of the Town and Country Planning (Local Planning) (England) Regulations 2012, the Core Strategy is a Local Plan and provides strategic planning policy up to the year 2027. Further information on the Core Strategy can be viewed on the Council’s website at www.southglos.gov.uk/corestrategy.

15 November 2013 - update

21 June 2013 Update from the Inspector

Further to his update of 10 June, the Inspector has provided the following information:

I have reviewed the representations to the Further Main Modifications to the South Gloucestershire Core Strategy and have also had regard to the contents of the Council's letter of 7th June 2013. This included an update to Appendix A and Appendix B of the Council's Annual Monitoring Report of December 2012 (Examination Library ref: EB5/3) taking into account the conclusions of a study undertaken by BNP Paribas Real Estate. The latter was commissioned to provide an independent assessment of the deliverability of identified housing sites. I am now inviting comments on these latest documents including the Council's covering letter.

 These should be sent to the Programme Officer to arrive no later than 5pm on Thursday 25 July.

10 June 2013 Update from the Inspector

The Inspector has provided the following update:-

'As per my update dated 8 May 2013, I am now in receipt of a letter and enclosures from the Council dated 7 June.  I will consider this material along with the representations received to the consultation round on the further main modifications (ending 3 May) and the options open to me regarding the Examination process.  It is likely that I shall invite comments on the Council's latest submission and I hope to be in a position to advise interested parties of how I intend to proceed within the next ten days.

7 June 2013 Update

Following the Council’s response to the Further Main Modifications of 3 May, the Council has provided an additional response in relation to the impact of the Engine common appeal decision and the matter of the 5 year housing land supply.  This has been forwarded to the Inspector for his consideration and is available to read below.

Please be advised the suggested draft timetable referred to as enclosure 3 is attached at the end of the Council’s letter.

13 May 2013 - Update from the Inspector

The Inspector has provided the update below following the closure of the recent consultation.

'I have received the representations made during the most recent consultation on the South Gloucestershire Core Strategy.  I shall be considering these shortly and the options open to me as to how to proceed with the examination.  I have been made aware by the Council and other parties of the recent appeal decision at Engine Common, Yate.  The Council has acknowledged that this has implcations for the soundness of its Plan and has asked that I wait until the 7 June for further comments it wishes to submit on this matter.  I intend to do so before deciding what to do next'

8 May 2013 Update

The consultation on the Inspector’s Further Main Modifications, and the impact of the Secretary of State's intention to place an Order revoking the South West Regional Strategy and the recent release of ONS household projections for the period 2011 - 2021 closed on 3 May.  The Council will be taking steps to make the representations received available on its website as soon as practically possible. Ahead of that, the Council's response is available to view below. 

15 April 2013 Update

The South Gloucestershire Core Strategy Inspector invites comments on two matters which have come to his attention in the last few days.  The first relates to the Secretary of State's intention to place an Order revoking the South West Regional Strategy; the second covers the recent release of ONS household projections for the period 2011 - 2021.

The Inspector invites written responses on the implications of either or both matters for the South Gloucestershire Core Strategy.  He will have regard to these when completing his report on the Council's Plan. 

Statements should be sent to the Programme Officer no later than Friday 3 May. Links to the webpages containing further information/statistics are provided in the accompanying statements.

22 March 2013 Update - Consultation on Further Main Modifications

Further to the 20 March 2013 update the Inspector’s Further Main Modifications, supporting Sustainability Appraisal (SA) and the Council’s Further Additional Modifications have now been published. This will be subject to a 6 week period of public consultation, closing on 3 May 2013.

Please note that an incorrect version of paragraph 10.7 (in Appendix D) was previously shown. This has now been corrected (as at 22/3/13 16.25).

 20 March 2013 Update

The Council can confirm it received the Inspector’s Further Modifications on 18th March following the additional EiP hearing session held on the 7 March.  This is currently going through the proper process of a scrutiny check and preparation of the supporting Sustainability Appraisal.

 In respect of Morton Way and in particular the timings of the appeal into non determination of the planning application made by Bloor Homes Ltd, the Council on 19th March informed the DC West Committee of the Inspector’s findings.  This has confirmed that the site at Morton Way is recommended by the Inspector to be allocated in the Core Strategy.

 The Council anticipates the publication of the Inspector’s Further Modifications, supporting sustainability appraisal and Additional Modifications by Friday 22 March (it is not expected to be available until after 3pm), for the purposes of commencing the 6 week public consultation prior to the Inspector finalising his report.

12 March 2013 Update - Additional note from the Inspector

The Inspector has issued an additional note PA24 dated 11 March following last week's hearing session on the 7 March; a copy of which can be accessed via the link here.  A copy of this will also be placed in the Examination Library List.

21 February 2013 Update - Schedule of responses to Jan 2013 consultation

11 February 2013 update – Additional Hearing Session

The  deadline has now passed for responses to the two issues set out in the Inspector’s note (of 10 January) to be submitted to the Programme Officer. The Programme Officer is now collating the responses received and they will be passed to the Inspector in the next few days. 11 January 2013 update - Inspector’s note regarding additional hearing session

Further to the update note issued by the Inspector before Christmas, the Inspector has now issued a more detailed note regarding an additional hearing session on 7 March. The note is available to view here.

18 December 2012 update - Inspector’s initial reaction to the Responses received to the Draft Main Modifications

The Inspector appointed to undertake the Core Strategy's Examination has supplied the following note regarding the Examination's progression:

I have had an opportunity to consider the results of the consultation process on the draft Main Modifications to the South Gloucestershire Core Strategy. This includes the Council’s response as set out in its letter of 16 November 2012.

I have found the views put forward helpful in clarifying my views on a number of matters but I would not wish to complete my report before investigating the option mentioned by the Council of identifying an additional site capable of contributing to a 5 year housing land supply. I appreciate that this is being suggested by the Council as a last resort and should only be considered if I were to conclude it was unable to demonstrate an adequate housing supply.

If I was minded to pursue this approach I would be unwilling to settle on the Council's suggested site to the east of Morton Way at Thornbury (Appendix D of its response) without giving consideration to the other sites across the District which were brought to my attention during the examination. I would also want to allow all parties the opportunity to put forward their views on the choice of site. I intend to issue a more detailed note early in the New Year regarding the matters that I would like to examine further. Further consideration of these issues would be made without prejudice to the final conclusions I reach.

29 November 2012 update - initial response from Inspector

The Inspector has now received all the representations to the latest consultation regarding the draft main modifications, including the Council's. Going forward, he will look through all these in order to get a complete picture of how the different organisations, developers, interest groups and individuals have reacted to the draft main modifications.  However, as he is also engaged in other development plan hearings, he will not have sufficient time to do this before Christmas. His current intention, therefore, is to complete his assessment of the responses as soon as possible in the New Year. At that stage, he will decide what the remaining programme for any work is leading to the completion of his report.

Correction to map

It has been brought to the Council' attention that an error exists on the Ordnance Survey base map used in Appendix D (Response to MM15: Area of land at Morton Way(north), Thornbury) of the Council’s Response to the Inspector’s Draft Main Modifications. The base map indicated two subways under Morton Way, when in fact there is only one. A corrected Appendix D created by South Gloucestershire Council can be found here.

This error in the base map has been reported to the Ordnance Survey. Please accept our apologies for any confusion this may have caused. 

20 November 2012 Update - close of consultation on the Inspector's Draft Main Modifications

The six week public consultation regarding the Inspector's proposed Main Modifications ended on Friday 16 November.  All comments received are currently being collated by the council and will be forwarded to the Inspector for him to consider as soon as possible.  After the comments have been sent to the Inspector they will be published on the Council's webpage for information.  In advance of the comments being published the Council has published its response to the Inspector's main modifications, a copy of which can be found via www.southglos.gov.uk/corestrategy .

4 October 2012 update - consultation on the Inspector's Draft Main Modifications

Representations are now invited on the Inspector’s draft Main Modifications. All comments received will be passed to the Inspector for his consideration.  Please visit www.southglos.gov.uk/corestrategy for further details and how to respond.

Please note that the Inspector has made a number of minor errata changes to his Draft Main Modifications.  Therefore the version of the Draft Main Modifications published on the morning of 4th October supersedes any versions previously published.

14 September 2012 Update - Inspector's preliminary findings

The Inspector’s Preliminary Findings incorporating his draft main modifications are now available through the links below.

The Inspector’s suggested modifications will be subject to a 6 week formal public consultation. The Council is currently now progressing to prepare the necessary supporting sustainability appraisal and make arrangements for the consultation to commence. Details of this and the timetable for the public consultation will be made available shortly on the website, although it is currently anticipated consultation will start in early October. Everyone who has made representations on the Core Strategy will also be notified. All comments received, as part of this consultation process, will be passed to the Inspector for his consideration in drafting his final report.

11 September 2012 Update

The Council has now received the Inspector's preliminary findings incorporating his draft main modifications.  He has concluded that the December 2011 Core Strategy is capable of being made sound provided a number of modifications are made.  The Council has been given a short period of time to review the Inspector's findings and suggested modifications and once this has been completed, I will publish these findings on the examination home page, together with information on how the Council will progress the next stages of the Core Strategy.

Closure of Examination and next steps

The Inspector Mr Paul Crysell formally closed the Examination hearing sessions at the end of Wednesday 18th July and thanked all participants for ensuring that the Examination had run smoothly.  The Council would also like to extend its thanks to all participants and members of the public who attended.

At the close of the hearings Mr Crysell outlined the next steps.  He stated that he anticipated being able to supply the Council with his preliminary findings within approximately four weeks from the close of the hearings (this has since been updated to the end of August at the earliest).  Once the Council has received any suggested main modifications from him, the Council will be required to undertake Sustainability Appraisal on those modifications.  The Council will then advertise the modifications and the Sustainability Appraisal for comment for a period of six weeks.  It is anticipated that this will occur in late summer or early autumn. 

All of those who have made representations and/or who have asked to be kept informed of the Core Strategy’s progress will be written to or emailed to at the start of that advertisement period to inform them how to comment.  Comments received will then be collated by the Council and passed to Mr Crysell for him to take into account in drafting his final report and recommendations.

21 August 2012 - Library update

9 August 2012 Update

The Council have been advised that although the Inspector thought he would be in a position to provide them with his preliminary findings within 2/3 weeks from the close of the hearing sessions, this will not now be available until the end of August at the earliest.  As soon as the Council receive notification from the Inspector, an update will be placed on the examination home page and participants will be notified accordingly.

4 July 2012 update - Week 4 Further Sessions - Important Information and Library Updates

The Inspector has now confirmed that he will be holding further sessions in Week 4.  The rearranged Matter 28 Communities of the East Fringe will take place on Tuesday 17 July (pm) and on the 18 July (am/pm) the Inspector wishes to cover the following areas:-

•  Revisions to policy CS15 & the provision of a 5 year housing land supply
•  Consideration of alternative policy wording in relation to the Mall & Cribbs  Causeway
•  Options for taking the CS forward
•  Initial views of key policy changes put forward in the Council's 'Schedule of Rolling Suggested Changes' (SRC1).
 
Thursday 19 July will be a reserve day should any sessions require to be carried forward from the previous day plus any matters during week 3 which necessitate inclusion as part of the additional sessions in Week 4.

21 June 2012 update - Library updates

The Council has today re-issued matter statement PSM22 (Communities of the North Fringe).  The reference of the republished document is PSM22/1. Appendix B in PSM22 has been replaced with a corrected version.

An erratum to PSM24 (Major Infrastructure and Oldbury Nuclear Power Station) has also been published – the reference of this erratum is PSM24/1.  The erratum to PSM24 has been released to correct the errors in the original release.

The Council has also today published a Rolling Schedule of Suggested Changes (ref SRC1) in the Examination Library (link above).  This schedule draws all of the changes suggested so far by the Council further to the December 2011 Post-Submission Changes. This schedule of rolling suggested changes is being published by the Council to aid all parties before and during the Hearing sessions. The changes proposed are those suggested by South Gloucestershire Council and are being presented to the Examination for consideration by the Inspector. It is a living document that will be regularly updated during the Examination and Hearing sessions.

The Council’s Affordable Housing Supplementary Planning Document has also been added to the Examination Library (ref: RD64).

15 June 2012 update - Commencement of Hearing Sessions and Library update

Please note that the Examination will start promptly at 10am on Tuesday 19th June in Kingswood Council Chamber.  As this is the first day there are likely to be many people attending, therefore attendees are advised to make sure they arrive early so they are able to park and register to enable the session to start on time.

26 April 2012 update - Revised Programme, Matters and Issues

The Inspector has now published the final Pre Hearing Meeting Notes (PHM) following the meeting on the 17 April and also the Core Strategy EiP Revised Programme, Matters and Issues.  The EiP Programme of Hearing Sessions will commence on Tues 19 - 22 June (Week 1); Tues 26 - 29 June (Week 2); Week 3 will commence on Wed 11 - 13 July.  The fourth week (17 - 20 July) is reserved for any outstanding matters.  The PHM Notes, Programme, Matters and Issues can be read here and here.   The letter can be read here.

22 March  2012 Update

Inspector Mr Paul Crysell, has been appointed to carry out the Examination in Public (EiP) of the South Gloucestershire Core Strategy. Prior to the opening of the EiP, the Inspector will hold a Pre hearing Meeting (PHM) commencing at 2pm on Tuesday 17th April 2012 at the Kingswood Civic Centre, High Street, Kingswood, South Gloucestershire, BS15 9TR.

The purpose of the PHM is to help the Inspector and all interested parties prepare for the EiP. At the PHM the Inspector will outline the procedural elements of the EiP. The Inspector will not hear evidence on the merits of any proposal and those attending the PHM meeting will only be able to comment if invited to do so by the Inspector.

The Inspector has indicated he intends to commence hearings as part of the EiP on Tuesday 19 June 2012. The EiP will be held at the Kingswood Civic Centre, High Street Kingswood, South Gloucestershire, BS15 9TR.

The Examination Guidance Note, a letter to Core Strategy respondents and the agenda for the PHM are available in the Examination Library.  Further details about the timing and duration of the EiP will be published on this page and the Examination page (link below) as they become available. 9 March 2012 - Examination Library update

There have been a number of additional evidence bas and supporting documents added to the Examination Library since December 2011.  The updated library which lists all evidence base and supporting documents is now available.

The representations submitted on the December 2011 Core Strategy are intended to be published by the end of March.

 20 February 2012 Update - Closure of Publication Period

The official period for making representations on the Core Strategy (which incorporates December 2011 Post-Submission Changes) and other supporting documents closed at midnight on Friday 17 February. All representations received are now being acknowledged and collated and copies will be passed to the Inspector. Further information will follow shortly.
