Gating Orders were introduced under the Clean Neighbourhoods and Environment Act 2005, enabling local authorities to restrict the use of a highway under certain circumstances. Gating Orders apply to public rights of way or public highways only. If you wish to gate a private lane, your local Safer Stronger Community Group may be able to help you put an alley-gating scheme in place
Before a Gating Order can be considered, the Council must be satisfied that there are increased levels of crime or anti-social behaviour facilitated by the existence of the highway. Alternative methods of reducing crime or anti-social behaviour should have been explored.
A Gating Order cannot be made if the highway forms the only or principal means of access to dwellings, or the principal means of access to business or recreational premises during the hours that these premises are normally used.
There is a statutory consultation process which must be followed, the outcome of which will be used to inform if a Gating Order is made.
