Roads on new developments and highway adoptions

New housing developments

The Development Team is responsible for overseeing the processes necessary to secure adoption of new highways works constructed by developers. These are more commonly known as Section 38 agreements and Section 106 agreement highway works.

The team checks that submitted details are in accordance with both the approved highway layout (from the planning application) and technical details in relation to the construction of the roads. During the construction phase they supervise site operations liaising with developers, consultants and groundwork contractors.

Once the highway has been adopted the council will be responsible for its maintenance.

Section 38 and 106 agreements

There are some minor differences between the two forms of agreement but ultimately both deliver construction of highway infrastructure that will be adopted as public highway.

Adopted and unadopted roads

  • An 'adopted road' is a road under the control of the council which is therefore responsible for all the required maintenance and safety issues related to the road
  • An 'unadopted road' is a new or private road that has not yet met the standard of quality required by the council for adoption, therefore all the required maintenance and safety issues are the responsibility of the developer or owner
